Dear Utah Legislators, I urge your unanimous support for passage S.B. 201. What an honor to be alive and send you this message now. Accidents happen in life. And I will be having the privilege to speak to you at the Utah Capitol at the Senate Judiciary, Law Enforcement, and Criminal Justice Committee meeting in regards to this bill. I would like to publicly thank Utah Senator Curt Bramble for working with the Utah Department of Public Safety and myself as the Chief Sponsor of S.B. 201. If a Utah Justice Court has a process in place to close an infraction or class C misdemeanor case and has no intention to impact a persons driver's license then this should be the same for a DAC report. The DAC employment report is a detailed summary of a Commercial Drivers License holders driving record, which pulls public records from courts all over the Nation. Every CDL holder should be given the due process before the Utah Department of Public Safety for a Certificate of Eligibility for expungement if a Utah Justice Court has measures in place to not impact your driver's license and your insurance rates. We obviously understand why these already existing measures are in place and how even more serious it is if someone is going to loose their job, not be hired on for a job, or be turned down for a promotion over something Utah has determined a lesson learned penalty process. The sad fact is that Commercial Drivers License holders are being turned away from jobs or loosing the ability for a career promotion over this silly disconnect between the Utah Department of Public Safety and Utah Justice Courts. They need to be on the same page. Even though the Utah Department of Motor Vehicles has no record of these cases a DAC report is obtaining them, which is wrong. It is clear that Utah Code / Constitution under Title 77 (Utah Code of Criminal Procedure) in Chapter 40 (Utah Expungement Act) needs to be honored by the Department of Public Safety and or amended to create jobs in Utah and S.B. 201 does this. This would be wise as it would invite CDL holders to consider Utah as home for them away from being on the road. They might get apartments, condos, or homes in Utah and we all know that Utah would be collecting so much more tax revenue in this process. According to the Utah Expunging Adult Criminal Records Criteria for Expungement of Records of Crimes with a Conviction requires, Section 77-40-105, the following: the petitioner must first pay all fines, fees, restitution and interest. Unless a person has been pardoned for the offense, records of the following crimes cannot be expunged:
And a person cannot expunge records of any conviction if:
It is clear that a criminal class C Misdemeanor or Infraction public guilty verdict case is defined in Section 76-1-401 requires three years, from the time from date petitioner was convicted or released from incarceration, probation or parole, whichever occurred last, should be allowed by the Bureau of Criminal Identification (BCI - publicsafety.utah.gov) of the Utah Department of Public Safety to issue a certificate of eligibility to the petitioner, because they have meet all of the criteria for eligibility. And if a Utah Justice Court has arranged a Plea in Abeyance Agreement with Utah Municipal Cities, Counties, or State to allow for Traffic Court for criminal infractions to result in the case being closed without a public guilty verdict, then the case should be eligible for expungement after 30 days; from the date of the petitioner paying all fines, fees, restitution and interest. I ask for Section 76-1-401 be amended to allow for this Plea in Abeyance process of expungement after 30 days for criminal infraction or Class C misdemeanors. This would only make logistic sense since a Plea in Abeyance Agreement was intended to sealing the criminal case after the case has been resolved from the Utah DMV. Utah should do the samerestriction of public access to DAC and the only way to process an court expungement. And I realize expunged records are not necessarily destroyed. Expunged court records are placed in an envelope which is securely sealed. The clerk records the case number and record classification on the envelope and inscribes across the sealed part of the envelope the words "Not to be opened except upon permission of the court." The court record might eventually be destroyed in accordance with the court's Record Retention Schedule. And to start think about the fees generated from the, Subsection (1)(i)(i), Expungement $135.00 and Utah Department of Public Safety BCI charging a fee of background check being done each time. All I seriously ask is that we assist in creating jobs and revenue for Utah and be inviting for CDL holders to call our loving State of Utah home as so many others do. Senator Bramble, the Utah Department of Public Safety, and myself are working to put people back to work and let Truck Drivers across the Nation consider Utah their home away from home to enjoy life, liberty, and the pursuit of happiness. I publicly call him a friend because he has done so much in serving the constituency of Utah and our beloved Nation. Senator Hatch has served many faithful years for our Nation and his time to serve should end in humility and honor. Senator Hatch has gone to Washington with the best intentions. He has done many great things. And he has made some mistakes in voting and I expect seeing the good and bad from every elected official. I never expect my elected official to agree with me one hundred percent of the time. But the sad truth is that he is surrounded by too many people that expect too many things out of him that his constituency doesn’t need or want of him. More than half of his campaign funding is coming from lobbyist machines. His attempts to explain why he should stay in his position have failed at multiple levels of conversation amongst anyone I discuss his re-election with. The sum of all fears of any elected official is to be sucked into the Washington D.C. lifestyle that goes beyond anyone’s means of humility. Money and power can hypnotize the mind into doing wrong things. Every action in life only builds upon a person’s character. The overwhelming ego of pridefulness is damaging to oneself. How do we want to remembered? We each have a legacy to pass on in history. I am not perfect myself with pride and I value and appreciate when my friends step in and humble me back to reality. When is enough, enough for a politician? Why must one person stay in power for so many years? I really don’t find myself going too negative because voters in Utah have kept voting for Senator Hatch to be re-elected all these years and obviously they kept doing so for a reason. But when is enough, enough? Thirty-six years sounds like enough to me. When is not time to come home and spend time with your family and appreciate the American Dream? There are over six billion people on this planet earth and there are more and more willing to take up the mantle and make a change in the world for good. No one needs to keep the position of power until death. That only brings dictatorship to anyone’s mind. America is the land of the bold and free where we have blessed opportunities to grow, experience, and learn. I value and appreciate those in office who get elected and serve a purpose then come home with honor, much like those in serving in the Military. Just like any Grandfather, Grandmother, Father, or Mother who understands that we all want to pass on the opportunity for our children to experience the things we have experienced, but in a greater keen of comprehension and ability of success, I ask for any elected official to find the same sense of comprehension when seeing the time to pass on the mantle of responsibility on to the next generation of humanity in government. Why campaign with negative attacks on your character? I realize every campaign has negative attacks. But when our life nears to our very end, why not retire with dignity and respect. A career politician defeated at re-election only brings a bad taste of corrupt government to anyone’s mind, which is a path that is very unnecessary when retirement is always an option. At a time when public opinion polls are down of elected officials, should we not see all elected officials taking responsibility and a course of action to bring up those polls? Now I feel like I am not asking much of Senator Hatch, if I was then I would ask him to retire with dignity and to ask the future Utah United States Senator to hire him as Chief of Staff. Now that would be humble and historic. Not everyone needs to be President of the United States to make a difference in America. I value and honor the capacity of all serving leaders in every level of government and would like to see all representatives serving with charisma that would surpass all historic levels. That is what I see in the American Dream. So please Senator Orrin Grant Hatch retire this year and continue to assist in the American Dream by using your level of influence for good by working behind the scenes, as every American Voter does. Iran won’t be able to retaliate directly, so they will probably call on the mad dogs in Iran’s pay in the West Bank, Gaza Strip and Lebanon to attack Israel. Since the end of the Iran-Iraq War in 1988, Iran has largely pursued a strategy of deterrence. Its ground forces, which number roughly 450,000, are trained and equipped to fight a prolonged, asymmetric defensive battle on its own territory. Likewise, Iran's air force can protect high value domestic targets such as the Natanz uranium enrichment facility and numerous military and political headquarters inside Tehran; it is incapable of long-range strike missions abroad. Which is why there has been no preemptive strike by the United States against Iran having Nuclear long range capability. Iran simply does not possess the capability to project hard power into neighboring states. The serious Iranian immediate threat is to start attacking Persian Gulf oil shipments. The OPEC prices are fearing a global economic disaster that World leaders are not prepared to handle at the moment. In any case, we have recently increased our Navy fleet out there in the Persian Gulf just to prevent Iran from stopping the oil flow, and I’m sure they’ll be very good at it. Also on the other side of that gulf, and the owner of most of those ships, is Saudi Arabia, their worst enemy.Iran may also launch its army into Iraq, so that might put a hold on the plan to pull out the 400,000 United States troops there. The Allie to Iran, China, Foreign Ministry weighed in on the widespread anxiety over Iran's nuclear program on today, urging Iran to be flexible with the U.N. nuclear agency but staunchly deploring force amid talk of strikes against the country. Hong Lei, the ministry spokesman, made the comments, state-run news agency Xinhua said on Friday. They come ahead of a report on Iran's nuclear program expected to be released next week by the International Atomic Energy Agency. "As a member of the Nuclear Non-Proliferation Treaty, Iran should fulfill the relevant international obligations," Hong told reporters. Due to a diplomacy relationship between The United States and China the United States military wouldn’t be green-lighting this War operation by Israel. Most Republican Candidates have been publicly commenting on the battle that is yet to come. Rick Perry said "As a Christian I have a clear directive to support Israel." Herman Cain said "If You Mess With Israel, You're Messing With the USA." Mitt Romney said "The right course for us is not to try and negotiate forIsrael. ... that we will stay with them and that we will support them and defend them." I’d like to know just what ships we have in that gulf right now. I heard on CNN today a reporter today say we had over 30 Navy ships sent there recently, but I haven't been able to Google that factually written, I guess that is probably supposed to be classified? I do know that the Saudis months ago gave Israel free passage through their skies to attack Iran. Defense Secretary Leon E. Panetta was quoted October 24th that "we’re going to strengthen our presence in the Pacific.” Were sending a clear signal that the United States opposes China’s claims to island territories far beyond its shores. So the U.S. is pivoting eastward to address are uneasy Allies before this crises takes place. Looks like all the ducks are lining up nicely. The Iranian navy plans to provoke the United States by moving Iran naval vessels out of the Persian Gulf and into the Atlantic Ocean, "near maritime borders of the United States," the Tehran Times reported Tuesday.Rear Admiral Habibollah Sayyari a top Iranian Naval officer told the Tehran Times that “As the global arrogance (forces of imperialism) have a (military) presence near our sea borders, we also plan to have a strong presence near the U.S. sea borders with the help of the soldiers who are loyal to the vali-e faqih (supreme jurisprudent)."Iranians might face a challenge in refueling its fleet. Some in the Pentagon have speculated it could gas up in Venezuela, whose President, Hugo Chavez, is known to have a close relationship with Iranian president Mahmoud Ahmadinejad. President Barack Obama will be claiming the victory of this War because of our “secret” support and assistance, and there’s nothing like a war during an election year to assure a second term for an incumbent president. I think this is the only reason Obama is suddenly being supportive of Israel. So how will all of this affect you? The price of oil will no doubt go up a bit but Iran only contributes maybe 5% of the total OPEC Global supply, so it won’t be much in the long term but will immediately go up very high due to the media fear mongering paranoia hysteria. So stay calm. I think Israel will “accidentally” go beyond the agreed parameters of their assaults on Iran, the so-called Palestinians, and Hezbollah if they also attack, and really crush the hell out of them. Hello Friends, I've got ice in my veins, blood in my eyes, pain in my heart, and love in my mind. I've seen nights full of pain, days of the same, and I keep the sunshine saved inside of me. Sometimes I feel like when it rains it pours, but never find myself hurt. I never cry anymore and I work forever and still feel cursed. I never mind it for worse or better but times seems further and beyond. The top of my challenges always seem to feel higher the more that I climb. Yet they spot my insecurities as life feels smaller and I get bigger about goals. I need to try and get myself somewhere that I can fit in a room and not feel the ego lift from things that have made me strong. So I need to pick the world up and drop it on another politicians head, yeah I need to pick up World and drop it on others like I have with Chris Cannon, Bob Bennett, and soon to be Jim Matheson. If I died now I would rebirth and leave your tiny little issues behind me and seek eternal happiness. I know why you don't want me to say this, career politicians, but I just hope heaven sends you proof that everyone wakes up in this World with lights cut off and confidence gone from your service while in government. My world may be of pride and wisdom but its bleak and that's my word to the wise so we can all survive in our communities. I am tired of the thug murders and bribes, with money, when someone feels like a burden needs to be put aside. I do hurt as any other person but I never show it out in public. There is a pain you’ll never know, if only you can see just how lonely and how cold and frostbit I’ve become. It seems as if my back is against the wall and when push comes to shove I just want to stand up and scream the heck with politics. Sometimes it feels like these walls are closing in and this roof is caving in. It's time to raise the ceiling and then all you selfless career politicians will know that your days are numbered like pages in my book of life. It's time for career politicians to be cooked as they understand that they need to be scared when they look into my eyes. I am very patient and I take my time to build plenty of friends and when the time is right my game plan is for you to be careful when you bring up my name amongst anyone. I am not one to claim fame and fortune, but I am never going to be the same as you. I swear all you hate mongers make me stronger. I am a God fearing man who will search in darkness for the iron rod and everyone knows I am a man of my word so your heads better nod when you see me enter a room. First you need to consider about how the social networking Universe works is the gravity of the information you’re passing along. Gravity is influence, context, and facts. Next you need to apply the rules of adding extra gravity to be just right enough to experience a big bang, similar to how the planet earth began. The perfect amount of gravity is still just a fraction of a second sending the information out by an unbelievable amount of incredible speed. If I were to give you an actual time table I would say it needs to spread out in less than a millionth, of a millionth, of a millionth, of a millionth of a second. Yes social networking information can flow that fast. For the record that is faster than the speed of light, which does break one of the laws of physics. Even school children know you can’t go faster than the speed of the light, but there is a loop hole to this. Nothing can go faster than light, nothing meaning open space. Yes I realize this will give even scientists headaches but social networking is meant to be fast and efficient. So this speed is called Planck time. This is how fast social networking is meant to be and instruments such as Facebook has made this possible. To understand how Planck time works there is more units in Planck time in one second since the big earth bang, yes the math is mind blowing. This time period is so small that human intuition goes out the window. If even a person were to look at their watch than it would be a billion, billion, billion, billion, billion Planck times. The exploding mass of information traveling faster than the speed of light as we know it is how social networking in the Universe works. A fraction of the second after the information is put out in the World Wide Web the information can sit in the palm of your hand via phone applications, email, and text. But in another tiny fraction of a second it expands to others around the earth and moving faster than the speed the light it grows larger than our solar system and still is a ranging storm of information traveling in our social networking Universe. Social Networking information is more violent than anything you could experience in the Universe today. Even the interior of the Sun is more calm and serene than how social networking works. The raw energy of the explosion of the internet transforms information to sub atomic particles, which is the first matter of the Universe. This conversion of matter to energy was predicted by Albert Einstein. This is known even to children as E=MC2. This illustrates how the big impact of Albert Einstein is involved with how fast destruction can travel. A similar depiction is with the discovery of destruction traveling via an Atomic Bomb explosion. In just a fraction of a second after the big bang the building blocks of social networking the explanation begins to take shape. But this first matter of atoms or earlier stages of sub atomic particles must be sent via a stable rate. The extreme nature of society and communication energizes the information. This races the information to travel at incredible speeds. It’s pure chaos. Eventually things calms down and people cool down and read the facts of the information. All of this is happening in fractions of a second into people’s finger tips. But this is when the big bang of social networking in the Universe is traveling into a critical stage of a titanic battle. The one thing that can destroy the information before it even gets started, Antimatter. From the smallest rock to the largest star in the Universe there is always Antimatter. This was created by the pure energy of the big bang. Einstein’s theory was that energy transforms into matter and matter can transform into energy. We do social networking with electronic tools similar to a Hadron Collider. For a split second we submit turbo charged communication and human movements to change the human thought process similar to how a Hadron Collider is functioning with antimatter. So the question arises, what communication and pure energy was sent to us from the beginning of time? Where do we come from? If we look at how matter works we see matter has a positive charge and locks arms with its enemy antimatter that has a negative charge. The fate of communication lies in the balance to these two. This is fair and balanced. There would be nothing interesting if there was not opposition in communication. But there must always be a champion. So just like a social networking game of ‘risk’ the side with the most matter wins. That is where survival of the fittest relies upon. The side that has more information flowing causing people to take side with them will win the hearts and minds in Nations, Communities, and Families. Social Networking in the Universe with technology isn’t very old and is still a strange thing for some. Only a decade ago most people would knock on a neighbor’s door and share information face to face verses sending a text. Some don’t tweet or know what a tweet is. But now all this is beginning to change as we see how everyone is becoming more wired to the social networking universe with technology. More and more cell phones are being distributed in light years in size compared to home phones being the only source for phone fifteen years ago. Even home phones are being converted to use new technology such as VOIP; voice over the Internet. The day will come where households will no longer accept paper mail and the postal office will just regulate your email data servers and your home address will be your internet IP address. The young social networking universe is currently having to cool down to slow down enough to allow the older generations to catch up. This period may take about 20 years in my prediction. When this happens, the billions on planet earth will all be plugged in to the World Wide Web. To capture the critical of images of the temperature of our planet earth the United States launched a satellite back in 1989 called the Cosmic Background Explorer. These first images were called the “face of God”. If we do the same but check who has internet access across the planet, earth, would we still call these images the “face of God”? I say yes! These heat maps of the planet earth via internet access would show who and what is communicating more and were and how it isn’t. These are the fluctuations that created all of us humans to be alive today. So why not keep communicating? As with astronomy, Stars in the Universe allow galaxy’s to grow in majestic beautiful fashion. Planets circle the Stars and I would compare that to information. It’s a common wish of great minds that all information in Nations and Communities keep flowing so they may continue to grow in majestic beautiful fashion. Any Nations of Communities seeking to hide or stop free flowing information do so at their own self-destruction. So I ask what or who are the Stars that will keep spreading the messages of the “face of God” to you? I say social networking in the Universe is infinite and will continue to only grow. New communication tools will eventually expand so large that we will change humanities communication in a run-away mode that will push all us. Figuring out how this might all change is a mystery as the Universe itself. If it self destructs it might trigger another big bang in communication. Maybe this has already happened and this is never ending. Some might say that this occurred with the death of copper telecommunication. But everything we enjoy in communication never really began by Mark Zuckerberg founding Facebook in his dorm room at Harvard, but over fourteen billion years ago.  Psalm Sunday One of the most set apart and known days in the World is Psalm Sunday. This day is known for the Sunday feast prior to Easter Sunday. The feast commemorates the Jesus triumphal entry into Jerusalem which is now celebrated as a Holy week. According to the Gospels Jesus rode a donkey on this journey into Jerusalem. History symbolism illustrates that the donkey is a animal of peace. As Jesus made his journey it is recorded that people celebrated and laid down their cloaks in front of him and also small branches of trees. Everyone was singing “Blessed is He who comes in the name of the Lord.” It is estimated that there are over 6.9 billion people on the earth today and thirty-three percent are known to be Christian, which is a follower of Jesus Christ. But as I have gone around in my journey in life I have meet people from almost all denominations who have respected or honored the principled teachings that come from Jesus Christ. The hope of where we all came from and where we’re all going to end up is spoken of in reverence with mutual respect. I personally feel like I have walked the steps along with Christ on his journey into Jerusalem. Especially during some really difficult patches in my life where I have felt helplessness and suicidal over some poor decisions I’ve made. I am not perfect and when I ask for forgiveness from God I do so in the name of Jesus Christ. His infinite love for me has made my life bearable. And when I say I feel like I have walked the steps along with him I say so from the personal experiences I’ve had with family and friends lifting me up and providing me with the tools to go on living. I have been taught that we are alive so we may experience things, be tried and tempted to do evil, and learn wisdom so we may pass on our strengths and talents to others. To pass down more opportunities for our Children, family, and posterity that we might have never been afforded the opportunity to do. This is turn circles my mind back to the journey that Christ provided all of us by his example into Jerusalem. He knew what was at stake and he knew exactly what was going to happen and yet he continued on his journey. And so I continue through my journey knowing that for whatever strengths and capacities I have to do good that evil wants me working on their side even more. I emphasize more because I have my Agency to good and if I choose to do good than blessings are afforded to me. And so evil wants me even more because it would provide me a life of bondage, which isn’t very appealing eternally and only is temporary happiness. So when Psalm Sunday comes around I have found myself with the appreciation of God in my heart, words, and actions. This day is a beacon of hope that is essentially needed in my humanistic existence. I am nothing without Christ. I am nothing without the words of Christ at the Last Super right before his journey into the crucifixion “Love one another. As I have loved you, so love one another” Bible John 13. Those last words of wisdom are known as his great and last commandment. It will be a sad day if I have no love for family and friends and my heart would no long beat as if a drum beat of hope to others. So on this Psalm Sunday, I promise to myself that I will continue to march on to live another cliff hanging journey through experience, trial, and knowledge and I do so with Christ standing next to me.  1984 Discovery Launch The word discovery is embedded in all humanistic characteristics. Since birth we have discovered and have savored every moment into memories to regret or revere for all time. When we mature into adulthood many seek to discover new things through their career or seek to hear about new discoveries from outside our planet. In 1984, the same year I was born, NASA launched the spaceflight called the Discovery shuttle to achieve space exploration. The Discovery shuttle has had thirty-nine missions and on Wednesday March 9th, 2011 it comes home to earth for the last time. In honor of Discovery's final flight, the astronauts received the first live wake-up with music in the history of the shuttle program, a tune written in honor of the spaceship; "Blue Sky." Space is a cold dark place and yet astronauts are able to discover hope, life, and memories to regret or revere for all time. With over 6.8 billion humans on earth and a growing number of 212, 035 a day we find ourselves waiting for these new space exploration discoveries to affect us. American’s have teamed up with other Nations to drastically increase the pace of discoveries by having an International Space Station circling our planet up and running twenty-four hours a day and all seven days a week. Since my birth I have always gone the extra mile discovering ways to comprehend other languages and cultures. These two vital significant parts of a person explains how the person communicates with others. For example the commonly used political gesture “thumbs up” in the United States is an insult to those in Bangladesh, Iran, and Thailand. It is equivalent to the use of the middle finger in the Western World. When I reach across barriers and communicate with someone out of love I find myself discovering the true meaning of happiness. The hardest thing for any human seems to be discovering the definition of love. We cannot even find the recipe for love in the Universe. Yet I have discovered love in many facets in my life. The recipe never seems to be same but the outcome is. The basic foundation of love is something or someone that is always by your side for better or worse. It’s ironic how other planets in our solar system have always been by our side throughout decades as our planet has changed. On the remembrance of the historic spacecraft Discovery I honor love. Is this a far stretch? Or is this an opportunity to pay tribute to those who for better or worse have dedicated their lives for discoveries. Discoveries that provide us an opportunity to reach for the sky and always do the impossible. Even if that means to be in love, something every person on this planet has in some facet played a role in searching for. I believe our elected officials must operate in the open, and with an open agenda and HB477 goes against that. Once someone is elected as a public official than their life is public and transparency is required. I am doing all I can to put my last-minute brakes on this ill-conceived GRAMA-gutting legislation WHEREAS, the Utah Republican Party Platform states: "We demand honesty, integrity, morality, and accountability of our public officials" and further states: "We will work to expose and stop corruption."; WHEREAS, the Utah Republican Party supports our republican form of government "by, through, and of the people" through elected representatives who are answerable to the people and who are empowered only by the consent of the governed; --RESOLUTION PASSED ON SATURDAY, NOV. 21 2009 IN BOUNTIFUL, UTAH. Whenever I find time I have attended immigration discussions across the State of Utah and I have spoken privately with Governor Herbert several times as well about immigration reform. I steer away from the negative rhetoric on illegal immigration and stick to the facts. I have an open mind and big heart when I speak to fellow Hispanics and fellow conservatives pushing for immigration reform. My own Uncle, Mario Rodriguez, has over 20 years of experience as an Immigration Attorney with Law Firm Offices in the U.S. & Colombia; giving me some insight on illegal immigration. I feel as if my best place for the Utah Immigration discussion is to be a peace maker. I attended the House Services Standing Committee meeting on HB116, Guest Worker bill, and listened on that bill. Honestly, I went in against the bill. Then after listening to Farmers across the State of Utah speaking in favor of the bill I felt torn between the Constitutionality of the bill and the need for Legal Immigrants. Vice Chairman Dean Sanpei kept asking for speakers for and against the bill and so I texted him and told him if he would ask for someone torn in the middle that I would gladly speak before the committee. Well that was comedic. I realize that the federal government is the only authorizing agency to issue visas, green cards and other proper work permits. But my gut tells me and farmers facts seems like were likely to obtain a Federal Waiver. Yet my conservative friends attacked HB116 for being a form of amnesty for illegal aliens. For allowing current illegal Utah immigration to enter the Guest Worker program and allowing them to sponsor a family member. HB466 has the common ground to satisfy the needs of Farmers and Tax Payers across Utah. I feel that the Legislators in Utah are definitely heading in the right direction.
